Arbitration—as a heteronomous dispute resolution mechanism—is of paramount importance in corporate law due to the unique characteristics of corporate conflicts. The diverse and varied nature of corporate disputes today presents serious challenges that translate into losses for companies and, often, even prevent them from continuing their operations. It is precisely here that the ineffectiveness of the judicial system becomes apparent in adequately resolving—in the time and manner required by commercial activity—the dissimilar conflicts that arise. This course will enable professionals to develop the skills to work in the field of international arbitration, either as arbitrators or as advisors to companies that choose to use this dispute resolution mechanism. The course will focus on the concepts and implications of shareholder disputes, the importance of corporate arbitration, drafting the articles of association, analyzing arbitrable matters, the arbitration process, issuing the award, and the possibility of extending the effects of the arbitration clause to third parties. In this sense, the course will open doors to a well-established professional network of referrals, advice, and greater professional satisfaction.
