The siege of the Supreme Court

Academic/Unit: Manuel García-Mansilla.

Criticism and attacks on the Judiciary in general and the Supreme Court in particular These have been a constant in our country in recent years. This obsession with eroding what Alexander Hamilton considered the weakest of the three branches of government has intensified since the end of last year. Proof of this lies in the constant criticism from the Executive Branch and  recent bills introduced by some senators who intend to triple or quadruple the number of Supreme Court justices. This critical impulse stemmed from the indignation expressed by the current government regarding the Court's December 2021 ruling in the case "Buenos Aires City Bar Association v. National State." In that ruling, the Court declared unconstitutional certain articles of Law 26.080 that had modified others in a previous law (Law 24.937) which regulated, among other things, the composition of the Council of the Magistracy.
