Specialists from the Faculty of Law will represent the judges illegally removed from the Supreme Court of Honduras before the Inter-American Court of Human Rights.

Gómez, professor of human rights, along with her colleague Fabiola Cantú, They will represent the victimsRosalinda Cruz Sequeira, José Gutiérrez Navas, José Ruiz Gaekel and Gustavo Bustillo, former magistrates of the Constitutional Chamber of the Supreme Court of Honduras.

Thus, the specialists will participate in the case of the arbitrary and illegal removal of four of the five magistrates of the Constitutional Chamber of the Supreme Court of Justice of Honduras. Ten years ago, the victims were removed from their positions by the National Congress, which lacked the authority to do so, in the early morning hours and with the building surrounded by the armed forces. The removal was not subsequently reviewed by the courts.

The Court will hear the victims, witnesses and experts, the arguments of the lawyers, those of the State and of the Inter-American Commission, in order to resolve in due course on the possible international responsibility of the State.

"Honduras and the region face a major challenge in terms of judicial independence and violence against justice operators. The entire continent will undoubtedly benefit from the resulting sentence,” says Ignacio de Casas, who is also Academic Secretary of the Faculty of Law at the Universidad Austral.

At the same time, Lucas Gómez emphasizes the connection that exists in this case with our country today:There are certain similarities with what is happening in the region, and also in Argentina. The impeachment proceedings being pursued against the four justices of the Argentine Supreme Court should take into account the recent jurisprudence of the Inter-American Court of Human Rights.And, possibly, what the Inter-American Court decides will undoubtedly have an impact on public opinion and on the country's politics.”

Ignacio Boulin, who is also the Coordinator of the Diploma in Human Rights at the Faculty of Law, agrees and adds: “The jurisprudence of the Inter-American Court has a marked influence on the decisions of the courts in Argentina.The guarantees and rights that the Court clarifies and expands in this case, including for the situation in Honduras, They could be used by the courts of Argentina if there were a removal of the Judges of the Court of our country; or it can serve as a deterrent against proceeding with impeachment if it becomes very clear that it will be an impeachment trial that violates guarantees in Argentina.”
