Does the law create the activist judge, or does the activist judge end up creating the law? This webinar from the International Observatory on Fundamental Rights in Light of Solidarity Personalism proposes to revisit the age-old chicken-and-egg dilemma applied to one of the most current debates in international law: the role of jus cogens in the creation—and not just the interpretation—of law by the courts.

Does judicial activism interpret jus cogens, or does it end up creating it? Where is the line between applying the law and creating it?

Ligia De Jesús Castaldi, Max Silva Abbott and Pilar Zambrano, specialists in international law and philosophy of law, will discuss this dilemma from their respective academic backgrounds.
